Privacy Policy
Privacy Notice for Thanet Early Years Project
This notice explains what personal data (information) we hold about you, how we collect, how we use and may share information about you. We are required to give you this information under data protection law.

Thanet Early Years Project collects, uses and is responsible for certain personal information about you. When we do so we are regulated under the General Data Protection Regulation which applies across the European Union (including in the United Kingdom) and we are responsible as ‘controller’ of that personal information for the purposes of those laws.

The National Pupil Database (NPD)
We are required by law, to provide information about our pupils to the DfE as part of statutory data collections such as the school census and early years’ census. Some of this information is then stored in the NPD. The law that allows this is the Education (Information About Individual Pupils) (England) Regulations 2013.
The NPD is owned and managed by the DfE and contains information about pupils in schools in England. It provides invaluable evidence on educational performance to inform independent research, as well as studies commissioned by the DfE. It is held in electronic format for statistical purposes. This information is securely collected from a range of sources including schools, local authorities and awarding bodies.
The DfE may share information about our pupils from the NPD with third parties who promote the education or well-being of children in England by:

Keeping your personal information secure
We have appropriate security measures in place to prevent personal information from being accidentally lost, or used or accessed in an unauthorised way. We limit access to your personal information to those who have a genuine business need to know it. Those processing your information will do so only in an authorised manner and are subject to a duty of confidentiality.
We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

How long your personal data will be kept
We will hold financial information securely and retain it for 7 years, after which the information is archived or securely destroyed.

- Local multi-agency forums which provide SEND advice, support and guidance (such as EY Local Inclusion Forum Team (EY LIFT))
- Schools that you attend after leaving us
- Partner organisations signed up to the Kent & Medway Information Sharing Agreement, where necessary, which may include Police, school nurses, doctors and mental health workers and Kent Community Health NHS Foundation Trust
- Contracted providers of services (such as external photographers and catering providers) where consent has been given

General Provisions
- This policy applies to all personal data processed by Thanet Early Years Project.
- The Responsible Person (Kim Hammond) shall take responsibility for the Charity’s ongoing compliance with this policy.
- This policy shall be reviewed at least annually.
- Thanet Early Years Project shall register with the Information Commissioner’s Office (ICO) as an organisation that processes personal data.
Lawful, fair and transparent processing
- To ensure its processing of data is lawful, fair and transparent, Thanet Early Years Project shall maintain a Register of Systems.
- The Register of Systems shall be reviewed at least annually.
- Individuals have the right of access their personal data and any such requests made to Thanet Early Years Project shall be dealt with in a timely manner.
Lawful purposes
- All data processed by Thanet Early Years Project must be done on one of the following lawful bases; consent, contract, legal obligation, vital interests, public task or legitimate interest.
- Thanet Early Years Project shall note the lawful basis in the Register of Systems.
- Where consent is relied upon as a lawful basis for processing data, evidence of opting in consent shall be kept with the personal data.
- Where communications are sent to individuals based on their consent, the option for the individuals to revoke their consent should be clearly available, and systems should be in place to ensure such revocation is reflected accurately in Thanet Early Years Project’s systems.
Data Minimisation
Thanet Early Years Project shall ensure that personal data are adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed.
Accuracy.
- Thanet Early Years Project shall take reasonable steps to ensure personal data is accurate.
- Where necessary for the lawful basis on which data is processed, steps shall be put in place to ensure that personal data is kept up to date.
Archiving/Removal
- To ensure that personal data is kept for no longer than necessary, Thanet Early Years Project shall put in place an archiving policy for each area in which personal data is processed and review this process annually.
- The archiving policy shall consider what data should/must be retained, for how long, and why.
Security
- Thanet Early Years Project shall ensure that personal data is stored security using modern software that is kept up to date.
- Access to personal data shall be limited to personnel who need access and appropriate security should be in place to avoid unauthorised sharing of information.
- Where personal data is deleted, this should be done safely such that the data is irrecoverable.
- Appropriate back up and disaster recovery solutions shall be in place.
Breach

IT Policy and Procedure
Data security
Data security
All employees share TEYP’s responsibility under data protection legislation (Data Protection Act 2018) and must therefore keep up to date and comply with any changes to IT policies. Failure to comply with these policies may pose a serious risk to business protection and may result in disciplinary action.
Proper care should be taken to ensure that information held on TEYP’s IT systems or personally owned devices is not lost, disclosed, modified without authorisation or accessed by third parties. Sensitive data must be retained in accordance with data retention. Any personal data breach must be reported immediately to the Project Manager (or the Deputy Project manager in the Project Manager’s Absence) Thanet Early Years Project shall promptly assess the risk to people’s rights and freedoms and if appropriate, report this breach to the Information Commissioners Office (ICO) https://ico.org.uk/for-organisations/report-a-breach/
If you inadvertently access information (this includes emails, diary entries, letters, voicemail) of a private nature relating to another individual, you should respect that person’s privacy and not read/listen further once it has become apparent that the information is personal, unless expressly authorised to do so.
Asset protection
It is important that you exercise due care to ensure that TEYP’s IT equipment is protected from damage and theft.
Laptops must be secured when they are in use and must be kept in a lockable cupboard overnight or when they are left for long periods of time. Laptops should never be left in an unattended vehicle and should be kept out of the reach of children. Care should be taken when moving equipment and a suitable carrying case should be used at all times.
Under no circumstances should you lend a laptop or mobile phone to someone else unless this has been authorised by the Project Manager.
Theft or loss of hardware and software must be reported immediately. In the event of theft or loss of a PC/mobile phone/laptop, notify the Project Manager and Office Manager. As soon as it reasonably practicable, notify your line manager, ensuring that the details of all data that has been lost are provided. You are also required to contact the police and obtain a Crime Book Number and submit this together with an incident report to the Project manager.
When leaving TEYP, all equipment, including data storage devices, must be returned to your line manager prior to your departure together with all cases, cables and other peripherals issued to you during your employment with TEYP. It is an offence under the Data Protection Act to take client records containing personal information to a new job without permission.
Password protection
If you have been provided with a password to access any system or data held on behalf of Thanet Early Years Project, you must not share your user IDs or passwords with anyone, and if you do, you will be held responsible for any misuse. Details of any passwords you use must be given by the employee to the Project Manager at the time of issue. Passwords are not to be changed without the explicit consent of the Project Manager.
Unattended PCs and laptops must be locked using the key command control/alt/delete. Computers left unlocked and unattended may result in disciplinary action being taken by the user.
If you leave Thanet Early Years Project, you must provide details of passwords for accessing encrypted data and other relevant information to your line manager prior to departure.
Viruses
You should be aware of the damage that computer viruses can do to an organisation if not managed properly. Do not disable the anti-virus software and ensure you receive regular updates. Before using any removable media or email attachments from outside Thanet Early Years and files downloaded via a modem, you should ensure that they have been virus checked using approved versions of anti-virus software. If you are unable to do this, you should not open the file.
Computer misuse
Employees who are discovered unreasonably using the TEYP’s computers for personal and private purposes will be dealt with under the TEYP’s disciplinary procedure.
Vandalism of, or otherwise intentionally interfering with, the TEYP’s computers/network constitutes a gross misconduct offence and could render the employee liable to summary dismissal under the TEYP’s disciplinary procedure.
Employees are not permitted to log on to Ebay, social networking and video sharing websites such as Facebook, MySpace, Bebo and YouTube unless this is for a business and marketing use or use the Company’s IT systems to keep a personal weblog (“blog”) at any time. The use of MSN or other chat forums are also prohibited.
Use of the internet, email, telephone, text messaging, PDA’s and voicemail.
All communications made on Thanet Early Years’ systems remain the sole property of Thanet Early Years Project and should be used primarily for business-related purposes.
Inappropriate use of Thanet Early Years Project’s IT equipment and systems may lead to disciplinary action.
Internet
Access to the internet is provided primarily for business use. You must exercise caution in the type of material you view and download, in particular you must not:
- Access, download, store or forward offensive materials from any sites on the internet
- Use the internet for the advocacy of any religious or political cause
- Use the internet to carry out any private paid or unpaid work
- Unlawfully duplicate copyrighted or licensed software
- Use the internet in any other way which would reflect badly on Thanet Early Years Project’s reputation.
The use of email should meet the same standards as other published documents. Any email sent from Thanet Early Years Project’s system is effectively the same as a letter written on TEYP’s headed stationery and has the same legal status as paper communication.
You must ensure that emails which you are sending internally or externally comply with TEYP’s policies, in particular you must not:
- Send any material which would reflect poorly on TEYP’s reputation.
- Solicit money for personal gain or in the operation of personal business
- Originate or distribute chain letters, junk emails or similar correspondence, or misrepresent or impersonate the senders’ identity.
- Send threatening or harassing messages
- Distribute any form of indecent or offensive material’ this includes but is not limited to, pornography, racist, terrorist or sexual material.
- Send material that contains unsuitable language or images that may upset others. If in any doubt about the appropriateness of the material you are thinking of sending, do not send it.
- Send any material which may be considered detrimental or offensive about any other employee in the organisation or partners with whom we work.

Personal digital assistants (PDAs)
If you use a PDA, you must ensure you do not store any classified information, confidential emails, messages or passwords and alarm codes on it. You must ensure your PDA is suitably protected.
Monitoring
TEYP reserves the right to monitor its information systems at any time.
Use of portable storage devices
Some employees may be provided with portable storage devices, such as memory sticks, that can be plugged into the USB port of a computer. Whilst they are provided so as to allow for the backup, copying and transferring of files and images between an employee’s desktop or laptop computer, their small size and storage capacity makes them vulnerable to misuse. For this reason, any employee issued with these devices must not transfer any data to a third party computer (including one at home) without first having obtained approval from the Project Manager.
Any employee who transfers files to a third party without permission is likely to be subject to disciplinary action. In the event that this involves the deliberate transfer of sensitive commercial information to a competitor, it is likely to be treated as gross misconduct.
Backing Up Data
It is the responsibility of the employee to regularly and accurately back up data held on their computer. Back up should be carried out on a memory stick and/external hard drive. All back up data must be held securely in the setting safe unless otherwise approved by the Project Manager.
Reporting Faults:
KCC systems
Faults or problems when using KCC systems should be reported to the Service Desk 03000 415555.
TEYP systems
Faults or problems when using TEYP systems should be immediately reported to the Project Manager on 01843 609634 or by email kim@thanetearlyyears.org
Ordering replacement ink cartridges for desktop printers
Original cartridges should be used for all printers under warranty. Quality compatible cartridges will be purchased for out of warranty printers wherever possible. These can only be purchased online by the TEYP Office Manager for settings through Amazon or other online sites as they are normally better value than purchasing locally. It is recommended that you always have one spare set of ink cartridges on hand and it is the responsibility of managers to ensure they request replacement cartridges be ordered when stock is low – allowing sufficient time for the item to be purchased and delivered. Please recycle old ink cartridges where possible.
Purchasing of new equipment
Permission must be obtained from the Project Manager before any new equipment is purchased.
Disposal of equipment
TEYP has legal obligations to ensure that all computers, IT equipment, and data storage media (e.g. USB drives, DVDs, CDs, etc.) including the data and software held upon such equipment, are disposed of appropriately and legally. Equipment must be disposed of in line with the EU Waste Electrical and Electronic Equipment (WEEE) Directive; data in line with the Data Protection Act 2018. The Project Manager is responsible for the disposal of all TEYP equipment, data and software and will follow current legal obligations in place at that time. No disposal may be made without the Project Manager’s authorisation.

Complaints Procedure
Thanet Early Years Project (TEYP) aims to provide the highest standards of care and education in all of our settings. Any complaints received from parents/carers are dealt with as a serious and urgent matter.
If you have a complaint or concern about any aspect of the services provided, it is imperative that you bring this to our attention in order for us to resolve any issues promptly.
It is a requirement of our regulator Ofsted that all complaints received in writing or by electronic mail that relate to one or more of the requirements or conditions of registration are investigated fully and the complainant must receive a written account of the findings within 28 days.
Our procedures for dealing with complaints are as follows:
